text-align: left;">一、职工工伤保险待遇申报条件是什么?</p><p><br/></p><p style="text-indent: 2em; text-align: left;">职工工伤保险待遇申报条件主要是:</p><p><br/></p><p style="text-indent: 2em; text-align: left;">1、存在劳动关?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">劳动者与用工单位签订的劳动合同能够直接证明存在劳动关系,现实生活中存在未签订劳动合同情况,以下情形可认定存在劳动关系?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(1)用人单位和劳动者符合法律、法规规定的主体资格;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(2)用人单位依法制定的各项劳动规章制度适用于劳动者,劳动者受用人单位的劳动管理,从事用人单位安排的有报酬的劳?</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(3)劳动者提供的劳动是用人单位业务的组成部分?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">认定双方存在劳动关系时可参照下列凭证?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(1)工资支付凭证或记?职工工资发放花名?、缴纳各项社会保险费的记?</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(2)用人单位向劳动者发放的“工作证”、“服务证”等能够证明身份的证?</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(3)劳动者填写的用人单位招工招聘“登记表”、“报名表”等招用记录;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(4)考勤记录;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(5)其他劳动者的证言等?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">其中?1)?3)?4)项的有关凭证由用人单位负举证责任?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">2、认定为工伤</p><p><br/></p><p style="text-indent: 2em; text-align: left;">职工有下列情形之一的,应当认定为工伤:</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(1)在工作时间和工作场所内,因工作原因受到事故伤害的;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(2)工作时间前后在工作场所内,从事与工作有关的预备性或者收尾性工作受到事故伤害的;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(3)在工作时间和工作场所内,因履行工作职责受到暴力等意外伤害?</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(4)患职业病?</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(5)因工外出期间,由于工作原因受到伤害或者发生事故下落不明的;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(6)在上下班途中,受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(7)法律、行政法规规定应当认定为工伤的其他情形?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">职工有下列情形之一的,视同工伤?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(1)在工作时间和工作岗位,突发疾病死亡或者在48小时之内经抢救无效死亡的;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(2)在抢险救灾等维护国家利益、公共利益活动中受到伤害?</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(3)职工原在军队服役,因战、因公负伤致残,已取得革命伤残军人证,到用人单位后旧伤复发的?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">职工在遭受工伤之后,要想享受工伤保险待遇的,那么首先要所在的单位为其购买了足额的工伤保险,此后经过专业的认定之后,确定属于工伤范畴了,那么才能根据实际遭受损害的情况享受相应的待遇?/p><p><br/></p><p style="text-indent: 2em;
