text-align: left;">买房子是件大事,可也有变卦的时候:到外地工作、看上另外的好房、要出国啦或发现购买的房子不如原来想象的那么好,想出手,或者资金紧张想“套现”等等,要把新买的房转让出去。可房子毕竟不是一般的商品,不知道该怎样进行转让?而最头痛的事是自己的房子是按揭买的房,不知能否一并把贷款转给下家?nbsp;</p><p style="text-indent: 2em; text-align: left;">这里,首先要弄清楚允许预售商品房转让的前提条件: </p><p style="text-indent: 2em; text-align: left;">开发商与买房人所签订的商品房买卖合同在有效期内; </p><p style="text-indent: 2em; text-align: left;">合同已经生效交办理了预售登记或交易手续、交清了相关的税?nbsp;</p><p style="text-indent: 2em; text-align: left;">在预售房屋还没有实际交付之前?nbsp;</p><p style="text-indent: 2em; text-align: left;">转让行为符合当地有关法规、政策,没有违法行为?nbsp;</p><p style="text-indent: 2em; text-align: left;">只要符合了上述四项规定,就可以办理预售转让手续了?nbsp;</p><p style="text-indent: 2em; text-align: left;">根据《重庆市房地产转让办法》的有关规定,预售合同登记备案后,预购人需转让预售商品房的,应当按照下列规定办理:?)尚未付清预售商品房总价款的,预购人应当在征得房地产开发企业同意后,与受让人订立预售商品房转让的合同;?)已经付清预售商品房总价款的,预购人可以与受让人订立预售商品房转让的合同,并书面通知房地产开发企业?nbsp;</p><p style="text-indent: 2em;
