text-align: left;">劳动者和用人单位之间常常因为劳动关系争议、劳动合同争议、解雇辞职争议、劳动保护争议、劳动报酬争议等各种劳动纠纷需要申请劳动仲裁?/p><p style="text-indent: 2em; text-align: left;"><br/></p><p style="text-indent: 2em; text-align: left;"><strong>一、劳动仲裁申请受理和裁决</strong></p><p><br/></p><p style="text-indent: 2em; text-align: left;">(一)递交劳动仲裁申请书及相关证据?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(?申请书符合要求的,仲裁委员会自收到申请书之日?日内做出受理或者不予受理的决定。仲裁委员会决定受理的,自做出决定之日起5日内将申请书副本送达被申请人,并组成仲裁庭;决定不予受理的,说明理由,申请人可以就该劳动争议事项向人民法院提起诉讼?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(?被申请人收到仲裁申请书副本后,应当在十日内向劳动争议仲裁委员会提交答辩书。被申请人未提交答辩书的,不影响仲裁程序的进行。当事人对自己提出的主张,有责任提供证据。与争议事项有关的证据属于用人单位掌握管理的,用人单位应当在指定期限内提供。用人单位不提供的,应当承担不利后果?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(?劳动争议仲裁公开进行,但当事人协议不公开进行或者涉及国家秘密、商业秘密和个人隐私的除外。仲裁庭在开庭五日前,将开庭日期、地点书面通知双方当事人。当事人有正当理由的,可以在开庭三日前请求延期开庭。是否延期,由劳动争议仲裁委员会决定?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(?当事人接到通知,无正当理由拒不到庭的,或未经仲裁庭同意中途退庭的,对申请人按照撤回申请处理,对被申请人可以缺席裁决?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(?仲裁庭处理劳动争议应当先行调解,在查明事实的基础上促使当事人双方自愿达成协议,并将协议内容制作调解书,调解书经双方当事人签收后,发生法律效力。调解不成或者调解书送达前,一方当事人反悔的,仲裁庭应当及时作出裁决?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(?仲裁庭裁决劳动争议案件,应当自劳动争议仲裁委员会受理仲裁申请之日起四十五日内结束。案情复杂需要延期的,经批准可以延期,但是延长期限不得超过十五日。逾期未作出仲裁裁决的,当事人可以就该劳动争议事项向人民法院提起诉讼?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(?仲裁庭做出裁决前,申请人撤回仲裁申请的,仲裁庭经审查后,认为其撤回申请成立的,向双方当事人发出《准予撤回申请决定书》;但被申请人提出反申请的,不影响反申请的审理?/p><p><br/></p><p style="text-indent: 2em; text-align: left;"><strong>二、仲裁申请人的权利义?/strong></p><p><br/></p><p style="text-indent: 2em; text-align: left;">1、当事人在仲裁活动中享有以下权利?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(1)有申请、答辩、变更、撤回仲裁申请的权利?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(2)有委托代理人代为参加仲裁活动的权利;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(3)有申请有关人员回避的权利?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(4)有请求传唤证人,请求鉴定和勘验的权利?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(5)对未发生法律效力的裁决,有向人民法院提起诉讼的权利;</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(6)对已发生法律效力的调解书、裁决书,对方当事人不履行的,有请求人民法院强制执行的权利?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">2、当事人在仲裁活动中应履行以下义务:</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(1)有遵守劳动仲裁程序和仲裁纪律的义务:</p><p><br/></p><p style="text-indent: 2em; text-align: left;">(2)有提供证人、证据的义务?/p><p><br/></p><p style="text-indent: 2em; text-align: left;">(3)有如实陈述案情,回答仲裁员询问的义务?/p><p><br/></p><p style="text-indent: 2em;
