$(".topic .hd i").removeClass("on"); }); }; </script> <div id="Main"> <form name="form1" method="post" action="./ShowArticle_Temp.aspx?ID=354" id="form1"> <input type="hidden" name="__VIEWSTATE" id="__VIEWSTATE" value="/wEPDwUKMjA5ODg5Mzk2N2QYAQUGZ3ZUYWdzDzwrAAwBCAIBZNQKeiIk11GqP624wVFF0BdXCPNpdes29bC9jIl+nL4D" /> <input type="hidden" name="__VIEWSTATEGENERATOR" id="__VIEWSTATEGENERATOR" value="EA2E7AE8" /> <div id="Nav">您的当前位置: <a href="/">捷律?/a> > <span id="lbNav"><a href="/flzs/fcjf/">房产纠纷</a> > <a href="/flzs/fcjf/spfjf/">商品房纠?/a></span> > 正文</div> <div id="Left"> <div id="Title"> <h1><span id="lalTitle">购房者逾期未去收房算违约吗</span></h1></div> <div id="Author"> 发布时间:<span id="lbInDate">2017/9/27 16:43:41</span>  <span id="lbSource"></span><span id="lbAuthor"></span>   阅读?<span id="Hits"></span></div> <div id="Content"> <span id="lalContent"><p>我们在购买商品房时,有时候会因为房屋问题而出现到期不收房的情况发生,那么购房者逾期未去收房算违约吗下面为大家整理了这方面的知识,欢迎阅?</p><p>碰到一些因房屋出现问题和开发商维权的业主,有的业主和我说,其实在交房前已经发现了问题,让开发商进行了维修,然后开发商就没有给业主再检查的机会了,一直等到交房那天,业主才看到了房屋的情况,再业主想详细检查的时候,开发商就会催促收房,并宣传到期不收房就会违约,业主需要交纳大笔违约费用,然后这位业主没办法之下就收房了,后面房屋还是出现了之前的问题,这下麻烦就大了?/p><p>那么到底业主到期不收房,会不会违约呢开发商为什么会有这个底气呢原因就在与购房者签订的这一条款?/p><p>该第三条是这样规定的:“以贷款方式支付房款的买受人须于入住时,缴齐办理房屋所有权和抵押登记所需各种资料及相关税费,积极配合甲方或代办机构共同办理产权登记和抵押登记手续,若买受人未将资料及费用办妥交齐,出卖人有权拒绝交付该房屋,并且乙方应于办理房屋交付之日起到实际接受之日止,每日向出卖人支付总房价万分之贰的”?/p><p>在对该条款的理解中,首先,我们认为该条规定因与国家强制性法律规范相冲突,因而不具有法律效力。《》第五十二条规定:“有下列情形之一的,合同无效:㈠…?㈤违反法律、行政法规的强制性规定”。《国家税务总局关于征收机关直接征收契税的通知?国税?2004 137?规定?“各级征收机关要?004?2?1日前停止代征委托,直接征收契税”?/p><p>上述合同附件五第三条的规定已经形成了事实上的代征关系,与强行法冲突,因此不具有法律效力?/p><p>其次,该条款属于开发商单方提供的格式条款,如果对该条款的理解存在争议,应当作出不利于提供格式条款的一方即开发商的解释。根据《合同法》第四十一条: “对格式条款有两种以上解释的,应当作出不利于提供格式条款一方的解释”。可能开发商会将其解释为不属于代征,而是代缴。但从业主的理解和认识来看,开发商收取的性质并非代缴。因为契税的征缴时间是从合同签订之日到产权证办理之前的时间段,由纳税人自愿决定何时缴纳,从自愿的角度出发,纳税人有选择晚缴的权利,否则就是具有强制因素,这与契税缴纳的自愿原则相违背。同时,税费应该在房屋交付以后才会发生,未先验房,存在拒绝收房的可能,也就存在不用缴税的可能性?/p><p>再次,业主实际上并未违反该条约定。从时间上讲,只有在买受人经过验房,确认了标的物符合合同约定并向出卖人表达进行交接的意思表示之后,继而才可能出现买受人想收房但拒绝缴纳相关税费的情形,在此之前,只存在买受人拒缴的可能性,不存在现实性,业主并未实际违约。开发商想依此陷阱条款追究业主违约责任的如意算盘,没有事实依据。相反,交房不能的原因是业主不能验房,不能验房的原因是出卖人制订执行不合理的交房流程,因此应由开发商承担违约责任?/p><p>所以大家以后就不用怕开发商再用这条条款催促收房了,也不用担心不及时收房就会违约的问题了!</p><p><br/></p></span> <div class="pages"> </div> <div class="bdsharebuttonbox"><a href="#" class="bds_more" data-cmd="more"></a><a href="#" class="bds_qzone" data-cmd="qzone" title="分享到QQ空间"></a><a href="#" class="bds_tsina" data-cmd="tsina" title="分享到新浪微?></a><a href="#" class="bds_tqq" data-cmd="tqq" title="分享到腾讯微?></a><a href="#" class="bds_renren" data-cmd="renren" title="分享到人人网"></a><a href="#" class="bds_weixin" data-cmd="weixin" title="分享到微?></a></div> <script> window._bd_share_config = { "common": { "bdSnsKey": {}, "bdText": "", "bdMini": "2", "bdMiniList": false, "bdPic": "", "bdStyle": "0", "bdSize": "24" }, "share": {}, "image": { "viewList": ["qzone", "tsina", "tqq", "renren", "weixin"], "viewText": "分享到:", "viewSize": "16" }, "selectShare": { "bdContainerClass": null, "bdSelectMiniList": ["qzone", "tsina", "tqq", "renren", "weixin"]} };
